Date: 2008-06-19 07:55 am (UTC)We got stupidly lucky here -- like Jerry said above, if Stevens had happened to kick out in the last year or two, the Supreme Fucking Court would have said that having a Gulag is totally constitutional. The fact that this decision wasn't 9-0 is a national shame.

And what I meant by being scared of America is that the Supreme Court being able to be Supreme is nothing new, and has always been scary. I read http://www.nytimes.com/2008/06/15/weekinreview/15mahler.html?pagewanted=1&_r=2&ref=weekinreview and past Justices have said some pretty scary things like:
βWhen a nation is at war,β [Justice Oliver Wendell Holmes] said, βmany things that might be said in time of peace are such a hindrance to its effort that no court could regard them as protected by any constitutional right.β
We're stupidly lucky all the time. And some of us are just stupid.
